New Duluth Councilor's Vote Called into Question

DULUTH - Controversy began to develop Wednesday night involving newly elected Duluth city councilor Joel Sipress.
According to letter from city attorney Gunnar Johnson addressed to councilors, Sipress may not be the winner of Patrick Boyle's seat after all.
The problem centers around how the council interpreted what's known as "ranked choice voting."
This process is used when the council continues to reach a tie vote during regular voting, which happened Monday night.
According to Johnson, and with the help of state expert FairVote Minnesota, the ranked choice voting also actually ended in a tie Monday night with candidate Kathy Heltzer.
So, what's the next step involving this election?
The city tells FOX 21 the process could be redone all over again or simply left alone, but it's ultimately up to the council.
In Johnson's letter, the city felt it was important to be as transparent as possible and make sure the council understood how the voting actual turned out.
