DULUTH - The owner of Last Place on Earth has filed an appeal against a judge's ruling that his business is a public nuisance.
That ruling shut down Jim Carlson's business for a year.
Duluth city attorney Gunnar Johnson said the city has overwhelming evidence that Last Place is a public nuisance, and it's disappointing that these cases are being dragged out when the Court of Appeals has already affirmed the first order on the public nuisance matters.
"It's highly unlikely that Carlson would be able to unwind all of his legal problems before the one year injunction on that building ends in November of 2014," said Johnson.
Carlson is still in prison waiting to be sentenced on 51 federal counts.
A sentencing date has not been set.
