MN Supreme Court Makes Ruling on Carter Hotel

DULUTH - The Minnesota Supreme Court has ruled that a case between the City of Duluth and the Fond du Lac Band is a matter for the federal courts to rule on.
The latest decision stems from a case where the city asked for a temporary restraining order that would not allow the Band to add the Carter Hotel on 2nd Ave. E. to trust land until all legal disputes between the two were over.

A local judge first said it was a federal matter.

Last spring, the Court of Appeals sent it back for the local courts to rule on before the Minnesota Supreme Court took it under review in November.

The city has been concerned that during this back-and-forth, a separate pending case about whether the Carter Hotel can become "trust land" could be ruled on.

If put into trust land, the ruling would be irreversible.
